1. Introduction and Acceptance of Terms

Welcome to MarbleTech ("we," "us," "our," or the "Service"). These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and MarbleTech.

By accessing, registering for, or using our web application available at https://calculator-for-marbles.web.app, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

2. Service Description

MarbleTech is a Software as a Service (SaaS) platform designed specifically for businesses in the marble, tiles, granite, and stone industry. Our Service provides:

• Marble & Tiles Calculator: Automated calculation tools for measurements, square footage, and material requirements
• Invoice Generation: Professional invoice creation and management system
• Quotation Management: Tools for creating and managing customer quotations
• Challan System: Delivery challan generation and tracking
• GST Management: GST-compliant billing and tax calculation
• Inventory Management: Stock tracking and inventory control
• Business Reports: Analytics and reporting tools for business insights
• Cloud Storage: Secure cloud-based data storage and access
• Work Order Management: Project and work order tracking

We reserve the right to modify, suspend, or discontinue any feature or functionality of the Service at any time without prior notice.

3. Eligibility

To use MarbleTech, you must meet the following eligibility requirements:

• You must be at least 18 years of age or the legal age of majority in your jurisdiction
• You must have the legal capacity to enter into binding contracts

• You must not be prohibited from using the Service under applicable laws

5. Free Trial and Subscription Plans

We may offer a free trial period (typically 7 days) to new users. During the trial period:

• You will have access to selected features of the Service
• No payment information is required to start the trial
• The trial automatically expires at the end of the trial period
• You may upgrade to a paid plan at any time during or after the trial
• We reserve the right to modify, suspend, or discontinue the free trial at any time

5.2 Paid Subscription Plans

After the free trial, continued use of the Service requires a paid subscription. We offer various subscription plans with different features and pricing, including but not limited to:

• Professional Plan: Advanced features including challan management
• Enterprise Plan: Full feature access including GST and inventory management
• Yearly Plans: Annual subscriptions with discounted pricing

Current pricing is displayed on our website. All prices are in Indian Rupees (₹) unless otherwise stated.

5.3 Plan Modifications

We reserve the right to:

• Modify subscription plans, features, and pricing at any time
• Introduce new subscription tiers or discontinue existing ones
• Change the features included in each plan

Existing subscribers will be notified of significant changes. Price changes will not affect your current billing cycle but will apply upon renewal.

6. Payments and Billing

6.1 Payment Processing

All payments are securely processed through Razorpay, a third-party payment gateway. By making a payment, you agree to Razorpay's terms and conditions. We do not store your complete payment card information on our servers.

6.2 Billing Terms

• Advance Payment: Subscription fees are billed in advance on a monthly or yearly basis depending on your chosen plan
• Auto-Renewal: Subscriptions automatically renew unless cancelled before the renewal date
• Payment Failure: If payment fails, your access may be suspended until payment is successfully processed
• Taxes: All fees are exclusive of applicable taxes (GST, etc.), which will be added to your invoice as required by law

6.3 Refund Policy

6.4 Subscription Cancellation

You may cancel your subscription at any time through your account settings or by contacting our support team. Upon cancellation:

• Your subscription will remain active until the end of the current billing period
• You will not be charged for subsequent billing periods
• You will lose access to paid features after the subscription expires

7. Data and Content Ownership

7.1 Your Data

You retain all ownership rights to the data you upload, create, or store using the Service ("Your Data"), including:

• Invoice and quotation data
• Business records and transactions
• Product and inventory information

7.2 License to Use Your Data

By using the Service, you grant MarbleTech a limited, non-exclusive license to access, process, and store Your Data solely for the purpose of:

• Generating anonymized analytics and statistics

We will not sell, rent, or share Your Data with third parties for their marketing purposes without your explicit consent.

7.3 Our Intellectual Property

The Service, including its design, code, features, functionality, and all intellectual property rights therein, are and will remain the exclusive property of MarbleTech. You are granted a limited, non-exclusive, non-transferable license to use the Service during your subscription period.

7.4 Data Backup

While we perform regular backups, you are solely responsible for maintaining your own backup copies of Your Data. We are not liable for any loss, corruption, or damage to Your Data.

8. Prohibited Activities

You agree not to engage in any of the following prohibited activities:

8.1 Abuse and Misuse

• Using the Service for any illegal, fraudulent, or unauthorized purpose
• Creating false invoices or engaging in tax evasion or fraud
• Violating any applicable laws or regulations
• Harassing, threatening, or intimidating other users
• Spreading malware, viruses, or harmful code

8.2 Technical Violations

• Reverse Engineering: Attempting to decompile, reverse engineer, or discover the source code of the Service
• Unauthorized Access: Attempting to gain unauthorized access to the Service, servers, or networks
• System Interference: Interfering with or disrupting the Service or servers
• Data Scraping: Using automated tools to collect data from the Service without permission
• Bypassing Security: Attempting to circumvent security measures or access restrictions

8.3 Account Misuse

• Creating multiple accounts to abuse free trials or promotions
• Sharing account credentials with unauthorized parties
• Reselling or sublicensing access to the Service
• Using the Service on behalf of competitors for competitive analysis

Violation of these prohibitions may result in immediate account suspension or termination without refund.

9. Service Availability and Maintenance

9.1 Service Uptime

While we strive to provide reliable and continuous service, we do not guarantee that the Service will be uninterrupted, timely, secure, or error-free. Factors that may affect availability include:

• Scheduled maintenance and updates
• Emergency maintenance and repairs
• Third-party service provider outages (Firebase, Razorpay, etc.)
• Force majeure events beyond our control
• Network connectivity issues

9.2 Maintenance Windows

We reserve the right to perform scheduled and emergency maintenance at any time. We will make reasonable efforts to:

• Schedule maintenance during off-peak hours when possible
• Notify users in advance of planned maintenance
• Minimize service disruptions

9.3 Service Modifications

We reserve the right to modify, update, or discontinue any aspect of the Service, including features, functionality, and user interfaces, at any time without prior notice or liability.

10. Account Termination and Suspension

10.1 Termination by You

You may terminate your account at any time by:

• Cancelling your subscription through account settings

Upon termination, you will lose access to the Service and Your Data after the current subscription period ends.

10.2 Termination by Us

We reserve the right to suspend or terminate your account immediately, without prior notice or liability, if:

• Your payment fails and remains unpaid
• We are required to do so by law
• We believe your actions may cause harm to us, the Service, or other users

10.3 Effect of Termination

Upon termination of your account:

• Your right to access and use the Service immediately ceases
• All licenses granted to you under these Terms will terminate
• You will not receive any refund for unused subscription periods
• We may delete Your Data in accordance with our data retention policy
• Provisions that by their nature should survive termination will remain in effect

10.4 Data Retrieval

You are responsible for exporting Your Data before account termination. After termination, we may delete Your Data within 30-90 days, and data recovery may not be possible.

11. Limitation of Liability

11.1 No Indirect Damages

MarbleTech, its directors, employees, partners, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, revenue, or business opportunities
• Loss of data or information
• Business interruption or downtime
• Loss of goodwill or reputation
• Cost of substitute services

11.2 Limitation of Total Liability

Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid to us in the 12 months preceding the event giving rise to the claim, or ₹10,000, whichever is less.

11.3 Exceptions

These limitations do not apply to:

• Our gross negligence or willful misconduct
• Death or personal injury caused by our negligence
• Liability that cannot be excluded under applicable law

12. Disclaimers

12.1 "As Is" Service

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Accuracy, reliability, or completeness of information
• Uninterrupted or error-free operation

12.2 No Financial or Tax Advice

MarbleTech does not provide financial, accounting, tax, or legal advice. The Service is a tool for business management and invoice generation. You are solely responsible for:

• Ensuring compliance with applicable tax laws and regulations
• Verifying the accuracy of calculations and invoices
• Consulting with qualified professionals for financial and tax matters
• Maintaining proper business records and documentation

12.3 No Guarantee of Outcomes

We make no guarantees or warranties regarding:

• Business success or profitability from using the Service
• Specific financial or operational results
• Compliance with specific industry regulations
• Compatibility with all devices or systems

12.4 Third-Party Services

The Service integrates with third-party services (Firebase, Razorpay, etc.). We are not responsible for the availability, functionality, or security of these third-party services. Your use of third-party services is subject to their respective terms and conditions.

13. Indemnification

You agree to indemnify, defend, and hold harmless MarbleTech, its officers, directors, employees, contractors, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any law or regulation
• Your violation of any third-party rights
• Your Data and its accuracy
• Any fraud or misconduct by you or your employees

14. Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes, we will:

• Update the "Last Updated" date at the top of this page
• Notify you via email or through a prominent notice on the Service
• Provide reasonable notice before material changes take effect

Your continued use of the Service after any changes to these Terms constitutes your acceptance of the revised Terms. If you do not agree to the modified Terms, you must stop using the Service and cancel your account.

15.3 Dispute Resolution

16. Miscellaneous

16.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and MarbleTech regarding the Service and supersede all prior agreements and understandings.

16.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

16.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

16.4 Assignment

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, strikes, internet outages, or government actions.

These Terms are written in English. Any translation is provided for convenience only. In case of conflict between the English version and any translation, the English version shall prevail.

By using the Service, you consent to receive electronic communications from us. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

16.8 No Partnership

Nothing in these Terms shall be construed to create a partnership, joint venture, agency, or employment relationship between you and MarbleTech.
